As of 2024, eighteen states plus the District of Columbia have mandated that employers provide paid sick leave, with 27 municipalities also enforcing similar requirements. The legislative landscape is rapidly evolving; Illinois and Minnesota recently enacted mandatory paid sick leave laws effective January 1, 2024. Furthermore, California has expanded its sick leave mandate from 24 to 40 hours annually. With the momentum building at the state level, a Federal mandate for paid sick leave is increasingly likely.

 

For employers with Federal contracts, paid sick leave provision is already a necessity. Those with municipal contracts should also scrutinize their agreements for paid sick leave obligations.

Each jurisdiction's paid sick leave law varies, creating a complex compliance environment. For instance, Vermont’s law activates after one year of service, while other regions require accrual after 90 to 120 days.
